2. Purpose, Legal Basis, Retention Period, and Data Recipients

The collected personal data is required for contract fulfillment, billing, assertion of contractual claims, customer service purposes, and compliance with legal requirements. The data is collected, stored, processed, and used for these purposes.

The legal bases for processing your personal data are, on the one hand, contract fulfillment (e.g., online purchase), legitimate interests, the fulfillment of our legal or contractual obligations, and, on the other hand, your consent (e.g., contact form, newsletter, cookies). Failure to provide the data may have different consequences.

We process your personal data, as necessary, for the duration of the entire business relationship (from initiation, processing to termination of a contract) and beyond in accordance with the statutory retention and documentation obligations arising, among other things, from the Austrian Commercial Code (UGB), the Federal Fiscal Code (BAO), as well as until the end of any legal disputes, ongoing warranty and guarantee periods, etc.

In the course of operating our websites, we commission software service providers and agencies who, in the course of their activities, may gain access to your personal data if they require the data to fulfill their respective services. They have committed themselves to comply with the applicable data protection regulations towards us. Data processing agreements have been concluded in accordance with Art 28 GDPR. Notary Mag. Klaus Berger uses technical and organizational security measures to protect the stored personal data against accidental or intentional manipulation, loss or destruction, and against access by unauthorized persons. Our security measures are continuously improved in line with technological progress.

For technical reasons, the following usage data, among others, which the user's internet browser transmits to the web server, is recorded:

  • Browser type and version
  • Operating system used
  • Website from which the user visits our website (“Referrer URL”)
  • Website visited by the user
  • Date and time of access
  • Internet protocol (IP address of the user's computer)

This data is stored separately from any personal user data provided, such as name, address, username, password, email address, telephone number, fax number, and is evaluated for statistical purposes in order to optimize our website and our offers.
